TERMS OF SERVICE

These Terms of Service govern your use of brokenstandard.ca and purchases made from Broken Standard.

By accessing the website, using our services or purchasing a product, you agree to these Terms.

1. ELIGIBILITY

You must have the legal capacity to enter into a binding agreement or have permission from a parent or legal guardian.

You agree to provide current, complete and accurate information when placing an order.

2. ONLINE STORE

Our store is hosted through an ecommerce platform that enables us to offer products and services online.

We may update, suspend or discontinue any part of the website where permitted by law.

3. PRODUCTS

We make reasonable efforts to display product colours, measurements, materials and details accurately.

Colours may appear differently depending on the device, display settings and lighting used to view the website.

Product availability is limited and may change without notice.

4. PRICING AND CURRENCY

Product prices may be displayed in Canadian dollars or another currency depending on the customer’s location, selected market or currency preference.

The currency and total amount displayed at checkout before payment will be the currency and amount charged for the order.

Prices displayed in currencies other than Canadian dollars may be automatically converted using exchange rates provided by Shopify, our payment providers or other currency-conversion services.

Broken Standard may also establish fixed prices for certain countries, currencies or markets.

Currency-conversion rates may change over time. As a result, prices displayed in another currency may change without notice.

A customer’s bank, card issuer or payment provider may apply additional foreign-exchange, currency-conversion or international-transaction fees. These charges are not controlled by Broken Standard.

Applicable taxes, shipping charges, duties, discounts and other fees will be displayed at checkout where possible.

If there is a difference between a price displayed elsewhere on the website and the final price shown at checkout, the price and currency clearly displayed before the customer completes payment will apply, subject to applicable law.

We may correct genuine typographical, technical, pricing or currency-conversion errors where permitted by law. If an affected order cannot be fulfilled, the customer will be notified and any amount paid will be refunded.

5. ORDERS

Submitting an order does not guarantee acceptance.

We may decline or cancel an order where permitted by law, including in cases of:

• Suspected fraud or unauthorized activity
• Invalid or declined payment information
• Inventory errors
• Shipping restrictions
• Suspected resale, automated purchasing or abuse
• A genuine technical, pricing or currency-conversion error

If a paid order is cancelled, the applicable amount will be refunded to the original payment method.

6. PAYMENT

You authorize Broken Standard and its payment providers to charge the payment method selected at checkout for the total amount of the order.

You are responsible for ensuring that your billing and payment information is accurate, complete and authorized.

Broken Standard does not directly store complete payment-card information. Payments are processed by Shopify and other authorized payment providers.

7. SHIPPING

Shipping and delivery are governed by our Shipping Policy.

Processing and delivery dates are estimates unless expressly guaranteed.

Broken Standard is not responsible for carrier delays, customs processing, weather events, labour disruptions or other circumstances outside our reasonable control.

Responsibility for products transfers as provided by applicable law.

8. RETURNS AND REFUNDS

Returns, exchanges, cancellations and refunds are governed by our Return & Refund Policy.

Nothing in these Terms limits any rights, legal warranties or remedies available under applicable consumer-protection laws.

9. INTELLECTUAL PROPERTY

All website content, including logos, brand names, product names, graphics, photographs, videos, text, designs and other materials, belongs to Broken Standard or its licensors and is protected by applicable intellectual-property laws.

You may not reproduce, distribute, modify, publish, sell or commercially exploit our content without prior written permission.

10. ACCEPTABLE USE

You may not use the website:

• For unlawful, fraudulent or abusive purposes
• To violate another person’s rights
• To upload viruses, malicious code or harmful software
• To interfere with the website’s security or operation
• To scrape, copy or extract content without authorization
• To impersonate another person or organization
• To submit false payment, account or shipping information
• To attempt unauthorized access to the website or related systems
• To resell products where expressly prohibited

11. THIRD-PARTY SERVICES

The website may contain third-party services, applications, integrations or links.

Broken Standard does not control and is not responsible for third-party content, policies, availability or practices.

12. REVIEWS AND SUBMISSIONS

If you submit reviews, photographs, videos, feedback or other content, you confirm that you have the right to submit it.

You grant Broken Standard a non-exclusive, worldwide, royalty-free licence to use, reproduce, modify and display the submitted content for business, advertising and promotional purposes, subject to applicable law.

You remain responsible for the content you submit.

You must not submit content that is unlawful, misleading, defamatory, infringing, abusive or harmful.

13. DISCLAIMER

Products and services are provided subject to all warranties, protections and legal rights that cannot lawfully be excluded.

To the maximum extent permitted by law, the website is otherwise provided on an “as available” basis without additional representations or warranties.

We do not guarantee that the website will always operate without interruption, delay or error.

14. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Broken Standard will not be liable for indirect, incidental, special or consequential losses arising from the use of the website, services or products.

This section does not exclude or limit liability, legal warranties or consumer rights that cannot lawfully be excluded or limited.

15. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify Broken Standard against claims, losses or expenses arising from:

• Your unlawful use of the website
• Your violation of these Terms
• Your infringement of another party’s rights
• Content you submit through the website

16. SEVERABILITY

If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply.

17. GOVERNING LAW

These Terms are governed by the laws applicable in Québec and the federal laws of Canada applicable there.

Nothing in these Terms limits any mandatory rights available to customers under the laws of their province, territory, state or country.

18. CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes to our services, business practices or legal obligations.

Updated Terms will be posted on this page with a revised “Last updated” date.

Continued use of the website following an update constitutes acceptance of the revised Terms where permitted by law.
